1. Agreement to Terms

By accessing or using Fivoon's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms constitute a legally binding agreement between you and Fivoon regarding your use of our MVP and SaaS development services.

2. Service Description

Fivoon provides MVP (Minimum Viable Product) and SaaS development services for businesses and startups. Our services include but are not limited to: project planning, design, development, testing, deployment, and maintenance of digital products. The specific details of the services provided will be outlined in the project proposal or agreement agreed upon by both parties.

3. Project Timeline and Delivery

Fivoon commits to delivering MVPs within the agreed-upon timeline, typically within 2 weeks from project initiation. This timeline assumes timely client feedback and approvals as specified in the project agreement. Delays in client feedback may result in corresponding delays in project delivery. If we fail to deliver within the agreed timeline due to reasons within our control, we will continue working on the project at no additional cost until completion.

4. Client Responsibilities

To ensure timely project delivery, clients are responsible for providing:

  • Clear project requirements and specifications
  • Timely feedback on deliverables (within 48 hours unless otherwise agreed)
  • Necessary access to accounts, systems, or information required for the project
  • Prompt payment according to the agreed payment schedule

5. Payment Terms

Payment terms are specified in the project proposal or agreement. Typically, we require a 50% upfront deposit to commence work, with the remaining balance due upon project completion. For larger projects, alternative payment schedules may be arranged. We accept payments via bank transfer, credit card, or other specified methods. Late payments may result in project delays and may incur additional fees.

6. Intellectual Property Rights

Upon full payment, clients receive ownership of the final deliverables, including source code and design assets specifically created for the project. Fivoon retains ownership of pre-existing tools, frameworks, and components used in the development process. We may use general concepts, programming techniques, and skills acquired during the project for future work. Clients are responsible for ensuring they have the necessary rights to any content or materials provided to us for the project.

7. Revisions and Modifications

Our packages include a specified number of revision rounds (typically two) for implemented features. Additional revisions or significant scope changes beyond the original project specifications may require additional time and cost. Any changes to the original project scope must be documented and agreed upon by both parties in writing.

8. Confidentiality

Fivoon agrees to maintain the confidentiality of all client information, project details, and proprietary data shared during the project. We will not disclose sensitive information to third parties without client consent, except as required by law. Clients may request a separate Non-Disclosure Agreement (NDA) before project commencement.

9. Project Termination

Either party may terminate the project with written notice under certain circumstances. If the client terminates the project, they are responsible for payment for all work completed up to the termination date. If Fivoon terminates due to client breach of these terms, payment for completed work is still required. In case of termination, all completed deliverables for which payment has been received will be provided to the client.

10. Limitation of Liability

Fivoon's liability is limited to the total amount paid for the project. We are not liable for indirect, consequential, or incidental damages, including loss of profits, data, or business opportunities. We do not guarantee that our services will be error-free or uninterrupted, but we will make reasonable efforts to address any issues promptly.

11. Warranty

Fivoon warrants that our services will be performed with reasonable skill and care, following industry standards. We provide a 30-day warranty period after project completion to address any critical bugs or issues. This warranty does not cover changes requested due to client preference changes or issues caused by third-party services outside our control.

12. Dispute Resolution

Any disputes arising from these terms or related services shall first be addressed through good-faith negotiation between both parties. If resolution cannot be reached, disputes will be settled through arbitration according to the laws of the jurisdiction specified in the project agreement.

13. Changes to Terms

Fivoon reserves the right to modify these Terms of Service at any time. We will notify clients of any significant changes. Continued use of our services after such modifications constitutes acceptance of the updated terms.
